"Always You Photography Ltd" cannot be held responsible for the lack of coverage for members of the wedding party not being ready on time, nor by restrictions enforced by officials of the church, registrars or licenced marriage venues. The company does not guarantee any specific image nor to include a specific backdrop, props, location but will make every effort to interpret the client's wishes. The client agrees to accept the technical results of their imposition on the company. Images will be of a similar style and colour to that shown on "Always You Photography Ltd" website www.alwaysyouphotography.com. The exact style and colour will solely be down to the discretion of the company and there is no right to reject images on the basis of style, colour and composition.
Both client and company agree to communicate and cooperate with each other to achieve the best possible result within the understanding of the given contract. It is recommended the photographer on the day be provided with a helper (such as the best man) who will point out key individuals to be photographed, as well as helping the photographer organise group shots. The couple agree to give sufficient warning of key events at the wedding to the company before the wedding day so our photographer has appropriate time to prepare for these events. Please note that some people do not wish to be photographed and the company cannot be held responsible for this. The client's guests may have digital cameras, portable devices and will want to take photos of the happy couple. In the spirit of cooperation the client agrees to give the photographer precedence over your guests in order to carry out the coverage agreed. "Always You Photography Ltd" cannot be held liable for a lack of wedding photos if guests taking their own photos prevent our photographer getting the desired photos.
3. Weather and/or delays
Weather permitting, the photographs will be taken as agreed. In the event of inclement weather the company, in cooperation with the client, will make the necessary changes to the schedule and will do their best to produce coverage within the time allocated to them.
4. Payment arrangement
A booking fee of £100 to secure the services on the date of the clients wedding is required on execution of the contract. This booking fee is non-fundable or transferable in the event of cancellation, it being the agreed loss suffered by the company due to cancellation.
Payment of the outstanding balance is required in full no later than 28 days prior to the wedding day as stipulated in the contract. Cancellation within 6 weeks before the date of the wedding will result in payment in full regardless of the fact that the service was not used. All cancellations must be made in writing via letter. The cancellation conditions will apply for postponed wedding if the company is unable to reschedule availability for the new date and time. The fee for postponed wedding is subject to change. Prices for orders placed over one year after the wedding day may be subject to change. This includes orders that maybe part of the initial wedding package e.g. the clients wedding book.
The copyright of all the photographs is retained by "Always You Photography Ltd" at all times. Where a disc of images has been produced the client is able to print, share and display online for personal but not commercial use. Unless specifically requested otherwise, "always You Photography Ltd" retains the right to use the images captured for business purposes including the use of photographs on social media applications. The clients grant the company the irrevocable and unlimited consent to use the photographs for editorial, competition, advertising and any other purpose and in any manner to alter the photographs without restrictions and to copyright all images.
The client is buying a license to use the photographs for the agreed use and no other, and for the agreed time period, if any, both as specified on the invoice. It comes into effect from the date of the job, unless agreed otherwise. The license is granted only on condition that the invoice is paid in full within one month; if it is not, the license will be invalid. The client cannot reassign the license to anyone else without the companys permission. Permission to use the photographs beyond the terms of the license must be obtained prior to such use, and will normally require an additional, mutually agreed, payment. In the case of social and domestic photography, the use does not include resale. If photographs sold as artworks are resold, full copyright details of the photographer must be supplied with them. Payment for social and domestic photography must be made prior to the shoot as specified on the price lists; a deposit may be required.
7. Ownership of Materials
All negatives, transparencies and digital files remain the property of "Always You Photography Ltd". Negatives or transparencies, if supplied, must be returned to the company, in good condition, within one month of the license to use expiring, and must be made available to the "Something You Photography Ltd" during the period of the license for self-promotional purposes. Prints and discs may remain in the client’s possession, provided they are used only in accordance with the license. In the case of social and domestic photography, and of prints sold as artistic works, the print remains the property of the client.
8. Exclusivity Period
"Always You Photography Ltd" will not use or re-sell the photographs during any agreed and specified exclusivity period, Except for self-promotional use. After the exclusivity period the company may use or resell the photographs for any purpose, unless that conflicts with confidentiality or privacy as outlined below.
9. Confidentiality and Privacy
"Always You Photography Ltd" will not disclose confidential material about the client or their business, except as necessary in order to carry out the commission, unless permission is given. Any content of the photographs which may be confidential must be identified at the time of commissioning the work; in such cases the company will not use the photographs for other purposes. In the case of photography for ‘private and domestic purposes’, the photographer acknowledges the client’s moral right to privacy, though it is assumed that by agreeing the commission the client gives permission to use the photographs solely for self promotional purposes. This use will not be made if the client informs the photographer that they prefer not to allow it.
Except as agreed beforehand, the client is responsible for obtaining any clearances or permissions necessary to undertake the commission. "Always You Photography Ltd" will not be responsible for any consequences arising from the lack of such clearances or permissions, unless they have specifically undertaken to obtain them.
"Always You Photography Ltd" will honour requests for specific photographs, time and weather permitting and subject to availability and cooperation of the person(s) concerned. All such requests are agreed before the date of the wedding.
12. Additional Costs and Cancellation
Any extra costs, materials or time required as a result of the client altering the brief must be paid for at the normal rate. If, after the agreeing the estimate, the client cancels the commission, any costs incurred to that date by "Always You Photography Ltd" will still be payable.
In the unlikely event that a photographer within "Always You Photography Ltd" is unable to complete the coverage due to unforeseen circumstances, "Always You Photography Ltd" reserves the right to appoint another photographer to attend on behalf of the company to undertake the pre-agreed coverage.
14. Right to a Credit
"Always You Photography Ltd" asserts the company’s moral right to have their name printed on or near all published reproductions of the photographs, and to be identified as the author, and the client accepts this when confirming the job. This will be confirmed in writing by marking the relevant box on the invoice when sent.
15. Electronic Storage and Manipulation
Except for the purposes of the licensed use, the photographs must not be stored or transferred electronically without permission. No part of the photograph be used or manipulated without permission.
Provided the brief has been fulfilled, the client has no right to reject the work on the basis of style, design or composition.
17. Limitation of liability
In the unlikely event of a total photographic failure or cancellation by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
18. Printed Output
Any printed output will be made to meet the agreed output to the best of our ability. Due to the nature of our business it is possible that we will be at the whim to publishers changes in printing techniques, therefore the final product may differ in some occasions. If this is the case this will be discussed with you the clients before it is sent to be printed.
Any variation in these terms and conditions must be agreed with the company in writing.
